RE: DECISION NOT TO GO TO AFRICA; ASANTE KOTOKO AND ADUANA STARS CAN RELY ON CAF COMPETITIONS REGULATION TO PARTICIPATE

After the much awaited meeting with the clubs by the normalisation committee, one of the key decisions taken was that no club in Ghana will be participating in the next CAF champions and confederations leagues. But just after the meeting a section of the management and supporters of Asante Kotoko feel gutted as they believed they have been given a raw deal.
This feeling they attribute to the fact that their team is currently on top form and make and a meaningful impact on the continent if given the opportunity.
Asante Kotoko is seeking to rely on this article in the CAF regulations to enter the competition. Section IV (6) of the CAF Confederation Cup Regulations states “If for any reason, the national cup of a federation did not take place, the federation in question has the right to submit the participation request of the same club(s) engaged having played the national cup and the national league from the previous season.”
My Take
Section IV (6) of CAF Champions league regulations the word used is that the federation has the right and not shall which means it’s not mandatory on the federation. So the federation can decide to let go or waive its right to participation if the federation (in this case the clubs) unanimously decides. A reliable source at the meeting informed me that the unfortunate aspect is that the representative of Asante Kotoko at the meeting never objected the motion of no club representing Ghana but rather voted in favour.
Asante Kotoko as an individual club cannot write to CAF to be included because the article above refers to federation having the right to submit names and not individual clubs. Kotoko had every opportunity to draw the federation’s attention to this article and entreating the federation to exercise that right in the regulations but maybe they were not aware of this CAF provision.
There could be a way out for Asante Kotoko if the so wish to participate by calling for another assembly to overturn the decision taken so that they can enter the competition. The normalisation committee cannot uniliterally rescind the decision taken by the whole assembly. Maybe all is not lost for Asante Kotoko.
